A estabilidade no serviço público face ao princípio da Eficiência

Abstract

The purpose of the research was to evaluate whether the employment stability in the public sector allows the public services to achieve the levels of efficiency proposed by the 19/1998 Constitutional Amendment. It had also as objective to assess the new model of public administration, named as “Managerial Administration” as well to present the 116/2017 Constitutional Amendment Project as a way of regulating the periodic public employee performance evaluation (provided by the article 41, paragraph 1, item III of the 1998 Brazilian Federal Constitution), being it a necessary condition for the maintenance of the public employee stability in order to achieve the required service efficiency. Such study was motivated by the low level of services rendered by some public agencies, by those who should reach the collective interest, and the lack of capacity of some public employees, which is not fulfilled by the State, leading to inefficiency. This research was based on doctrines, articles and master and doctorate theses in order to show how the employment stability is perceived by the public employee, and what are their objectives when pursuing a career in the public sector. It was also the objective of this work to demonstrate that the public employee performance periodic evaluation, when properly regulated, can increase the public services efficiency levels without jeopardizing the real goal of the employees’ stability in the public sector.
