dc.description.abstract | A inteligência artificial pode desempenhar um papel importante na modernização do sistema jurídico, mas é essencial garantir que ela seja usada de maneira ética e responsável, de modo a preservar os direitos fundamentais relacionados ao acesso à justiça. Mediante isso, o presente estudo tem como objetivo compreender se a aplicação de mecanismos de inteligência artificial no processo judicial eletrônico efetiva o direito ao acesso à justiça. A metodologia utilizada é de caráter bibliográfico, qualtitativa e indutiva. Inicialmente, será abordado o contexto histórico e a evolução da tecnologia até o ponto em que estamos, onde a IA encontra-se presente nas mais variadas relações humanas e não humanas. Por conseguinte, traça-se um paralelo entre a aplicação da IA no ordenamento jurídico brasileiro, observado o direito fundamental de acesso à justiça, assim como no processo eletrônico. Os resultados da pesquisa indicam que o direito de acesso à justiça não se limita apenas ao acesso aos tribunais, mas compreende o acesso a um sistema de justiça devidamente organizado, e esse acesso deve ser assegurado por meio de instrumentos processuais capazes de efetivamente realizar os direitos dos indivíduos. | pt_BR |

dc.description.abstract2 | Artificial intelligence can play an important role in modernizing the legal system, but it is essential to ensure that it is used ethically and responsibly to preserve fundamental rights related to access to justice. Therefore, the present study aims to understand whether the application of artificial intelligence mechanisms in the electronic judicial process enforces the right to access to justice. The methodology used is bibliographic, qualitative and inductive in nature. Initially, the historical context and the evolution of technology will be addressed to the point where we are, where AI is present in the most varied human and non-human relationships. Therefore, a parallel is drawn between the application of AI in the Brazilian legal system, observing the fundamental right of access to justice, as well as in the electronic process. The research results indicate that the right to access to justice is not limited only to access to the courts, but includes access to a properly organized justice system, and this access must be ensured through procedural instruments capable of effectively realizing the rights of individuals. | pt_BR |
